Draft pending legal review. This document describes how SoundJem works today, but it has not yet been reviewed by a lawyer and may change before launch.
These terms are the agreement between you and SoundJem. They cover the SoundJem website and mobile app, the music you stream or upload, the communities you take part in, and the Jems you earn and redeem. By creating an account or using SoundJem you accept them.
You need an account to use SoundJem. You must be at least 13 years old to create one, and you must give accurate details, including your own birthday. Keep your sign-in credentials to yourself; you are responsible for what happens on your account. Accounts are personal and may not be shared, sold or transferred.
There are two kinds of account. Fans stream music, take part in artist communities and earn Jems. Artists additionally publish music, run a community, offer rewards and connect a merch store. Uploading music is for artists, DJs and labels; SoundJem is not a place to store or share a personal music collection.
Posts, comments and display names pass through an automated profanity filter, which rejects content it flags rather than hiding it. Beyond that filter, you agree not to:
Anyone can report a post or track for spam, inappropriate content, copyright or another reason, and can block another account. Reports are reviewed by the SoundJem moderation team.
Artists keep ownership of the music, artwork and other content they upload. Every upload requires you to attest that you own the rights to the recording or have explicit permission to distribute it; SoundJem records that attestation and will not accept an upload without it.
By uploading, you grant SoundJem a non-exclusive, worldwide, royalty-free licence to host, store, encode, reproduce, stream and display that content so we can operate the platform, and to show it in previews, shared links and editorial playlists. The licence lasts as long as the content is on SoundJem. The same applies to posts, comments, stories and other content any user creates.
If you believe content on SoundJem infringes your rights, report it using the copyright reason on the post or track, or contact us through the support page. When we uphold a copyright report we remove the content and record a copyright strike against the uploading account. We email the account holder when this happens.
Three copyright strikes result in an automatic permanent ban, and all of that account's tracks are unpublished.
If you believe a strike was wrong, reply to the takedown email we sent with details of the rights you hold. We will review the counter-claim. Clearing a strike does not by itself lift a ban that has already been applied.
Jems are SoundJem's in-app points. Fans earn them for actions such as finishing a track, reacting to a post, commenting, following an artist, checking in daily, watching a rewarded ad, and buying merch from an artist's store. Most actions have a daily earning cap.
Artists create the rewards on SoundJem and set what they cost in Jems. When you redeem one, your Jems are deducted and the redemption is sent to that artist as pending. The artist — not SoundJem — is responsible for fulfilling the reward, and marks it fulfilled or cancelled. If a redemption is cancelled, the Jems are returned to your balance.
SoundJem does not guarantee that any reward will be fulfilled, and is not a party to what an artist promises. If a reward is not honoured, tell us through the support page so we can look into the artist's account.
Merch shown on an artist's SoundJem page is sold by that artist through their own Shopify store. Checkout happens on the artist's Shopify store, under its terms, privacy policy and refund policy. SoundJem does not take payment, ship goods, or handle returns, and is not the seller. Any dispute about an order is between you and the artist.
Ads are shown to fans and keep SoundJem free. Rewarded ads are optional, and the Jems they award are only granted after the ad network confirms the ad was genuinely watched. You control ad personalisation in Settings → Ad preferences and, on iOS, in the system tracking settings for SoundJem.
We may remove content, restrict features, suspend an account or terminate it permanently where we believe these terms have been broken, where the law requires it, or where an account puts other users at risk. Where we can, we will tell you what happened and why.
You can delete your own account at any time from Settings → Delete Account. The privacy policy explains exactly what deletion does and what is retained.
SoundJem is provided as it is. We do not promise that the service will be uninterrupted, that every track will always be available, or that content posted by other users is accurate or lawful. Artist content, rewards and merch are the responsibility of the artist who provides them.
To the fullest extent the law allows, SoundJem is not liable for indirect or consequential loss, lost profits, or lost data arising from your use of the platform. Nothing here limits liability that cannot be limited by law.
We will update this page as SoundJem changes and will move the “Last updated” date at the top. If a change is significant, we will tell you in the app. Continuing to use SoundJem after a change means you accept the updated terms.
Questions about these terms can be sent to support@soundjem.com or raised through the support page.
